Rental Terms and Conditions

  1. Definitions: “Customer” or “you” refers to the renter. “Kidtastic Costa del Sol” or “we/us” refers to the provider. “Equipment” means all items hired from us.

  2. Hire Agreement: We agree to hire the equipment to you as specified in our confirmation email/message at the agreed hire cost, subject to Clause 3.

  3. Order Refusal or Cancellation: We reserve the right to refuse or cancel an order due to reasons beyond our control, including stock unavailability. Customers will be notified at the earliest opportunity and any payments made will be fully refunded. Please note that refunds are only issued if the cancellation is made by Kidtastic.

  4. Currency and Taxes: All prices are in Euro (€) and include taxes.

  5. Delivery/Collection:
    Free delivery/collection at Aptito Supermarket, C. Pulpo 1, 29640 Fuengirola, Málaga. You may collect the equipment at a time convenient to you within the supermarket’s opening hours on the collection day and return it within opening hours on the day of return as confirmed in your booking, unless otherwise arranged.

    Collection at Málaga Airport via LockMate luggage storage in the arrivals hall. You are responsible for ensuring their opening hours align with your flight times. Your rented items must be collected within two (2) hours of your stated arrival time and returned no later than two (2) hours before your stated departure time. Collections or returns outside of these times may be subject to additional charges, paid directly to LockMate. A fee applies for this location.

    Home delivery and collection to other locations on the Costa del Sol is possible at a fee determined by the exact address in the areas between Málaga to Sotogrande. You may choose a convenient time for collection, but it is your responsibility to ensure someone is available at the delivery and collection address on the confirmed dates. Delivery and collection will be carried out by our staff or partners, and additional charges may apply if access is not provided as arranged.

  6. Express deliveries, including same-day or next-day start dates, may be possible but are not guaranteed. Customers are required to confirm with us via email when submitting a request with a same-day or next-day start date. This ensures we have received notice of your request in time. An additional fee of €15 applies to all express deliveries.

  7. Confirmation & Quote Validity: Upon confirmation of your order, please check all details thoroughly and notify us of any errors or queries within 48 hours. If no confirmation form has been submitted within the validity period stated on your quote, the quote will automatically expire and be deemed inactive. A new request will then need to be submitted. Any errors or queries must be received and amended before your confirmation; otherwise, we will assume all details are correct, subject to Clause 5.

  8. Substitutions: We reserve the right to provide a suitable alternative item of equipment if necessary due to circumstances beyond our control, including items not specifically listed on our website. In such cases, we will endeavour to ensure the alternative is appropriate and fit for the purpose of your hire, and we will notify you in writing wherever possible before delivery.

  9. Equipment Check: We kindly ask all clients to treat rental items with care so that many families can enjoy them. Normal wear and tear is expected, and most items may show signs of previous use. Condition details are provided for each product. You are responsible for checking the equipment immediately upon delivery to ensure it is in good condition and fit for purpose, and for reporting any issues to us on the day of delivery.

  10. Instructions and Safety: Instructions and installation videos are available for most items on our website. You are responsible for following these and for using the equipment safely and appropriately.

  11. Care and Supervision: You are fully responsible for the care and safekeeping of the equipment while it is in your possession. You must ensure it is used safely, sensibly, and only for the purpose for which it is supplied, following the manufacturer’s instructions at all times. It is your responsibility to provide adequate supervision where appropriate and to prevent any damage, misuse, or loss. Proper care helps ensure a safe experience and allows other families to enjoy the equipment as well.

  12. Equipment Return and Liability: If equipment is not returned on time, or is returned damaged, we reserve the right to invoice you for any applicable fees. This includes, but is not limited to, loss, damage, or cleaning beyond normal wear. In cases of serious loss or damage, issues may be referred to the police and are subject to a police report.

    Provided the goods are returned to us on the last date of hire in the same condition as you received them, and in the absence of any agreement to the contrary, no extra payment is needed.

  13. Damage or Loss: You are responsible for any damage, loss, or theft of the equipment during the rental period beyond normal wear and tear. This includes, but is not limited to, items requiring more than standard cleaning, such as persistent stains or odours that cannot be easily removed. You will be required to reimburse us for the market value of the equipment necessary to repair or replace it.

    Car seats involved in an accident are exempt from this requirement, provided a police report is supplied to us.

  14. Force Majeure: We are not liable for failures or delays caused by circumstances beyond our control or third-party providers.

  15. Cancellation by Customer: You may cancel or amend your hire at any time before the first day of the rental period. Please note that for cancellations made on the first day of the rental, we reserve the right to invoice you 50% of the total rental cost.

  16. Ownership: All equipment remains the property of Kidtastic Costa del Sol.

  17. Data Privacy: Personal data supplied will not be disclosed to third parties and are included in our customer file unless expressly opposed. In accordance with Spanish Law 15/1999 and Royal Decree 994/1999, clients may access and correct their data at any time by contacting rebecka@kidtasticcostadelsol.com.

  18. Jurisdiction: In the event of any dispute, only Spanish law shall apply. By collecting the items, the renter acknowledges that they have read, understood, and accepted these general terms and conditions.
